Probate
One of the most difficult situations anyone
has to face is the death of a relative or close friend. While
dealing with the grief of losing someone close to you, and
at a time when you do not want to think very hard about business
matters, you may find yourself having to establish the ownership
of the deceased’s person’s house and other assets,
generally referred to as his or her estate. The administration
of a person’s estate is often called Probate.
At Taylor Simpson and Mosley we have
been dealing with Probate matters for many years and we have
vast experience in this important field, helping our clients
in a sympathetic way to deal with all kinds of circumstances.
There may be a Will or the deceased may have died without
leaving a Will, in which case special rules determine how
the estate is dealt with and how the assets are distributed.
We establish what the deceased’s person’s
assets and liabilities were and assist our clients in preparing
the documents to apply for a Grant of Probate or a Grant of
Letters of Administration, where necessary. We deal with the
assets which may include a house, other property, land and
investments etc. We also deal with the liabilities and any
Inheritance Tax payment (minimising the effect of this wherever
possible) and we finalise the Income Tax position as well
as paying out legacies and dealing with the distribution of
the residuary estate.
